Xhaçka Case: EU Delegation Says Implementation of Constitutional Court Decisions Is Essential

"What happened yesterday is not a step in the right direction. The implementation of Constitutional Court decisions by Parliament is a crucial issue, as it relates to the institutional checks and balances in the country's democratic system." This was the response given by the European Union delegation in Tirana regarding yesterday's vote in the Albanian Assembly concerning Olta Xhaçka's mandate.

In its statement to Syri TV, the EU delegation expressed concern about the rule of law in Albania, specifically pointing to the lack of implementation of Constitutional Court decisions by Parliament.

"We have also expressed our concerns in the last report on the Rule of Law in Albania, regarding the fact that some decisions of the Constitutional Court have not been implemented by the Parliament, including in relation to this issue, where the decision of the Constitutional Court dates back more than a year and a half ago (January 2023)", the EU reacts.

The reaction further states: "We were encouraged by the fact that the Speaker of the Parliament, during the opening of the parliamentary session last week, emphasized as a priority the need for the Assembly to follow the remaining decisions of the Constitutional Court. What happened yesterday is not a step in the right direction. The implementation of the decisions of the Constitutional Court by the Parliament is an essential issue as it is related to the institutional checks and balances in the democratic system of the country".

It should be noted that the socialist majority once again defended their colleague Olta Xhaçka by rejecting the motion from 1/10 of the deputies in the Albanian Assembly to refer the mandate incompatibility request to the Constitutional Court.
